Terms of Service

These terms are the agreement between you and Mariam Lisette Pitti Rios about your use of KlubX. Please read them. If you do not agree with them, do not use the app.

What KlubX is

KlubX is a private app for car clubs. Your club keeps its garage, its drives, its events, its map of good workshops, and its conversations in one place, visible only to its members.

KlubX is free to use today and there is no advertising in it. That may change; see Money below.

Who can use it

You must be at least 16 years old.

There are three ways into a club: someone gives you an invitation code, you find the club in the directory and ask to join, or you create your own. Which of these a club offers is the club's decision, and who gets in is the club's decision too.

You are responsible for what happens under your account, so keep your password to yourself. Tell us at klubx.app@proton.me if you think someone else has got into it.

Clubs

A club is run by its owner and the admins the owner appoints. They decide who gets an invitation code, they can change members' roles, and they can remove members from the club.

If you are removed from a club, or you leave, you keep your account and anything you can take with you. Photos you added to a club event album stay with the event, without your name.

A club owner cannot leave a club without first handing it over to another member. A club with no owner cannot be run by anyone.

KlubX does not run your club and does not take sides in club matters. Disputes between members, and decisions about who is in a club, are the club's business.

If you create a club you are responsible for its name, its description and its logo. Do not make people think your club is run by a manufacturer, a dealership, a brand or another organisation when it is not. A club only appears in the directory if we approve it, and we can refuse a club, take it out of the directory, or remove it if its name or description is passing itself off as something it is not.

Asking to join a club is a request, not a right. A club can say no without giving a reason. Asking over and over is rate-limited by the app.

What you post

What you post stays yours. You are giving us only the permission we need to run the service: to store your content, and to show it to the people in your club who are meant to see it. Nothing more. We will not use your photos to promote KlubX without asking you first.

You are responsible for what you post, and for having the right to post it. Do not upload photos you did not take or do not have permission to use.

A word about number plates. KlubX does not blur them, and we would rather say so than pretend otherwise. There is no way to do it reliably on a phone, and doing it badly is worse than not promising it. If a plate in a photo matters to you, crop it before you upload.

Reporting something

If you see something in KlubX that breaks these rules or the law, report it from the post, photo, comment, message or profile itself, using the report option there. You can also write to klubx.app@proton.me.

Tell us what you are reporting, where it is, and why you think it is wrong. We will confirm we got it, look at it without undue delay, and tell you what we decided. If we take content down or restrict an account, we will tell the person affected why, and they can reply to us and ask us to look again.

We do this ourselves, by reading the report. Nothing is decided by an automated system.

You can also block another member. Blocking hides their posts, comments and messages from you, hides yours from them, and stops them from writing to you.

What we can do

If you break these rules, we can remove content, limit what your account can do, or close it. We will act in proportion to what happened, and we will tell you why unless the law stops us.

What your club's admins can do

A club runs itself. Its admins can remove a post, change your role, remove you from the club, and mute you for a while.

A mute is deliberately the smallest of those. While it lasts you cannot post, comment or react in that club's feed — and everything else keeps working: your garage, your drives, your statistics, and your private messages with anyone in the club. It is the difference between "not right now" and "not here", and it exists so that removing somebody is not the only tool an admin has.

You are told when you are muted and until when. A mute cannot last more than thirty days; past that, it stops being a pause and becomes a removal that nobody wanted to call one.

Admins are members of your club, not us. If you think one of them acted unfairly, write to klubx.app@proton.me.

Driving

This one matters more than the rest.

KlubX shows you what you drove. It does not tell you how to drive.

Places and reviews

Reviews of workshops and other places are the opinions of your club's members, not ours. We do not check them and we do not endorse any business. If you think a review about your business is wrong, write to klubx.app@proton.me.

Fundraisers

No money passes through KlubX. A fundraiser in the app is a shared record of what the club collected and from whom. The club moves the money by whatever means it already uses.

We are not a party to it, we are not a payment service, and we are not responsible for money your club collects, spends, or fails to account for. The amounts in the app are what members and admins typed in.

Money

KlubX is free to use today, and there is no advertising in it.

We may charge for some features in the future, offer paid plans, or carry commercial content such as a sponsored club or event. If we do:

We do not sell your personal information, and no commercial arrangement will change that. Any advertising we ever carry will not be based on profiling you.

Third-party material

Maps are provided by Mapbox. Business locations in the map search come from OpenStreetMap contributors and are used under the Open Database License (ODbL). The attributions shown in the app are part of those licences, and must not be removed.

The service itself

We will try to keep KlubX running and your data safe, but we do not promise that it will always be available or free of faults. It is provided as it is.

We are not liable for indirect or consequential losses, or for anything you could have avoided by keeping your own copy of something that matters to you. Nothing in these terms limits liability that the law does not allow us to limit — including for death or personal injury caused by negligence, or for fraud.

Ending it

You can delete your account at any time from Settings → Delete account.

We can suspend or close an account that breaks these terms, or stop offering KlubX altogether. If we shut the service down, we will give you reasonable notice and a way to take your data with you.

Changes to these terms

If we change them in a way that matters, we will tell you in the app before the change takes effect. The date at the top tells you which version you are reading.

Law

These terms are governed by the laws of the Republic of Panama, and the courts of Panama have jurisdiction — without prejudice to any mandatory consumer protection rules of the country you live in, and to your right to bring proceedings in the courts of that country. If you are a consumer in the European Union or the United Kingdom, nothing here takes away rights the law of your country gives you.
